Administrative Monetary Penalty System
One-Year Trial

The Township of Lanark Highlands is considering implementing an Administrative Monetary Penalty System (AMPS) as a one-year trial for the Clean and Safe Properties By-law.

AMPS provides municipalities with an alternative way to address certain by-law contraventions outside of the traditional Provincial Offences Court process. Instead of proceeding through the courts, an administrative penalty may be issued when there is reason to believe that a designated municipal by-law has been contravened.

The system is intended to provide a timely, fair and consistent approach to by-law enforcement, while giving individuals an opportunity to request a review of a penalty through an independent administrative review process.

For the proposed one-year trial, only the Clean and Safe Properties By-law would be included. Starting with one by-law will allow the Township to evaluate how the system works in practice before Council considers whether AMPS should continue or be expanded to other municipal by-laws in the future.
