NOTICE OF ADOPTION

OFFICIAL PLAN AMENDMENT NO. 6 ZONING BY-LAW AMENDMENT File No. ZA-2023-04 (Cooney Pit)

WHERE AS the Council of the Corporation of the Township of Lanark Highlands, having held a public meeting under Section 17 and Section 34 of the Planning Act, R.S.O 1990, as amended on June 24, 2025 passed By-law 2025-1975 Official Plan Amendment No.6 to the Township of Lanark Highlands Official Plan and Zoning By-Law 2025-1976 File # ZA-2023-04

AND TAKE NOTICE any person or public body is entitled to receive notice of the decision of the approval authority regarding Official Plan Amendment No.6 if a written request to be notified of the decision is made to the approval authority at the following address:

The County of Lanark, 99 Christie Lake Road, Perth ON, K7H 3C6 or

The request may be mailed, hand delivered or emailed. If you do not make a written request for notice of the decision of the approval authority, you will not be notified, notwithstanding you may have made comments or submissions in relation to Official Plan Amendment NO. 6 (Cooney Pit).

AND TAKE NOTICE that any specified person, public body or registered owner may appeal to the Ontario Land Tribunal in respect of By-law No. 2023-1976 by filing with the Clerk of the Corporation of the Township of Lanark Highlands a notice of appeal setting out the objection to the By-law, the reasons in support of the objection and the prescribed appeal fee of $400.00 not later than the 17th day of July 2025.

No specified person, public body or registered owner shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the specified person, public body or registered owner made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.

NOW THEREFORE the subject lands that are affected by an Official Plan Amendment (Township of Lanark Highlands file no. OPA No. No. 6 Cooney Pit) and a Zoning By-law Amendment (Township of Lanark Highlands file no. ZA-2023-04 Cooney Pit) are described as Part Lots 22 and 23, Concession 3, Parts 11 and 13, RP 26R1662, former Township of Darling, now the Township of Lanark Highlands..

THE PURPOSE AND EFFECT of Official Plan Amendment No. 6 to the Lanark Highlands Official Plan hereby amends the designation of the subject lands from Rural Communities” to “Mineral Aggregate Resource Policy Area – Pit” in accordance with Schedule “A” attached hereto and forming part of the By-Law.

The corresponding Zoning By-Law Amendment rezones the subject lands from “Rural (RU)” zone to “Mineral Aggregate Resources Pit (MXP)” Zone in accordance with Schedule “A” attached hereto and forming part of this By-Law.

The applicant has also applied for a site license under the Ontario Aggregate Resources Act, administered by the Ministry of Natural Resources and Forestry.

TAKE NOTICE Council of the Corporation of Township of Lanark Highlands received and considered comments from public bodies and general public in the development of the policies contained in Official Plan Amendment #6.

THE KEY MAP indicates the location of the lands affected by the Official Plan and Zoning By-law Amendments relative to other lands within the municipality. 

A COPY of Official Plan Amendment No. 6, along with additional information regarding the Amendment and other relevant background materials, is available for inspection between 8:30 a.m. and 4:30 p.m. weekdays in the Planning Department at the Municipal Building.
